BUSINESS RULES

The Platform shall facilitate purchase of Gold and Silver Coin for all individuals. Coin can be secured in advance through online pre-booking and you will be provided with a receipt as confirmation of your prepayment. The coin is set to be launched on Dussehra and after the launch, it will be delivered to you once the full payment has been made. Registered Members can buy in any quantity of gold and silver coin but only in specified weight on the Platform. The value of coin is in INR terms and includes GST.

COPYRIGHT

All content included on the Platform such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations and software, is the property of KanKanMeRam.com or its content suppliers and is safeguarded by international copyright laws and the graphics, logos, page headers, button icons, scripts and service names or features on the Platform are trademarks of KanKanMeRam.com. Copying, reproducing, republishing, uploading, posting, transmitting or distributing the Platform's content for any non-personal use is strictly prohibited without prior written approval from KanKanMeRam.com.

DISCLAIMER OF WARRANTIES

The Platform and its content, products(including software) and services provided by KanKanMeRam.com are offered "as is" and "as available," without any expressed or implied warranties, unless specified otherwise in writing. You expressly agree that your use of this Platform is at your sole risk. KanKanMeRam.com does not guarantee that its platform, content, products (including software) or services are free from viruses or harmful elements. KanKanMeRam.com is not liable for any damages arising from the use of its site or offerings, including direct, indirect, incidental, punitive, or consequential damages, unless otherwise specified in writing.

KanKanMeRam.com shall not be liable for any unauthorised credit/debit card or other payment instrument used for making any transaction on the Platform and shall have no liability to the true holder of any credit/debit card or payment instrument or to the concerned bank for any unauthorized/fraudulent use of the credit/debit card or payment instrument. KanKanMeRam.com shall not be responsible for any liability towards the true holder of the payment instrument or the relevant bank in fulfilling its obligations when dealing with a fraudulent transaction upon the realization of the purchase amount.

DISPUTES

Any dispute or claim arising from your use of the Platform or any products and services provided by KanKanMeRam.com or through the Platform will be initially resolved through arbitration. The Indian Arbitration and Conciliation Act of 1996 and including its amendments thereof applies to this agreement. To begin an arbitration procedure, you must send a letter to our address listed on the Platform requesting arbitration and detailing your claim in detail. The arbitration will be conducted in Surat by an independent arbitrator appointed by KanKanMeRam.com. On the merits of the case, the arbitrator will bear the costs of the arbitration proceedings. We each agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action.

ELECTRONIC COMMUNICATIONS

When you visit the Platform or send emails to us, you are communicating with us electronically. You consent to receive communications from us electronically. KanKanMeRam.com may communicate with you by letters, e-mail, SMS or by posting notices on the Platform. You acknowledge that electronic communications fulfill all legal requirements for written notices, agreements and disclosures.

EQUIPMENT

You shall procure and maintain all communication and other equipment necessary to access the Platform and the costs of any such equipment and communication connections or use, including any applicable taxes, shall be borne solely by you. FINANCIAL TRANSACTIONS AND TAXES

GOVERNING LAW AND JURISDICTION

This Agreement has been executed and delivered in India and shall be governed by the laws of the Republic of India, without conflict of laws principles and shall be subject to the exclusive jurisdiction of courts in Surat, India.

INDEMNIFICATION

You pledge to protect KanKanMeRam.com against any claims, damages or costs (including attorney's fees) made by any third party arising out of your content, your association with the Platform, your violation of this Agreement, KanKanMeRam.com’s Terms and Conditions.

INDEPENDENT INVESTIGATION

You acknowledge that you have read these Terms and Conditions of Access and Use and agree to them in their entirety. You understand that we may, at any time (directly or indirectly), solicit member referrals on terms that may differ from those included in these Terms and Conditions of Access and Use.

LICENSE AND SITE ACCESS

This authorization is granted without the need for any additional consent from the customer regarding such usage.

In addition, if required you fill and sign all forms and documents which form part of your account opening kit and supply us with all the relevant legal documents and financial information which law requires us to maintain. You can create an KanKanMeRam.com account with us by providing your mobile number and confirming it through the verification of the OTP (One-Time Password) sent to your mobile number.

DISAPPROVAL OF APPLICATION

ACCOUNT SECURITY

Upon completing the registration process with the Platform, the system will generate a unique customer id for you. You are responsible for maintaining the account's secrecy and are fully liable for all activities that occur under your account. You must promptly inform KanKanMeRam.com of any security breach, including unauthorized password or account use, and ensure that you exit from your account at the end of each session.

TERMINATION OF ACCOUNT

KanKanMeRam.com reserves the right to discontinue, in whole or in part, any portion of the Platform services or programs with or without notice to the Registered Member. KanKanMeRam.com reserves the right to terminate your account, password or use of the Platform at any time, including if you believe you have violated the Terms and Conditions of Access and Use. You can request termination by emailing the customer help desk. KanKanMeRam.com may deactivate or delete your account and related information without notice. It is not liable for any termination of access to the Service. If termination occurs, KanKanMeRam.com will refund the amount to your account.

INVESTMENT DECISIONS

KanKanMeRam.com may publish research and opinions on the Platform, for your information. You may not rely on any such information for forming your investment decisions. You acknowledge that KanKanMeRam.com or the Platform and its officers, directors, employees, merchants and affiliates will have no liability with respect to transactions in or for your Account and your investment decisions.

CUSTOMER ADVANCES

Registered Members have the opportunity to initiate a payment, referred to as a "Customer Advance," with KanKanMeRam.com. This advance payment serves the purpose of reserving a Gold and Silver coins on the platform in advance of purchase. It is essential to fully understand and acknowledge that once this Customer Advance payment is made, it becomes non-refundable. This means that the sum transferred to KanKanMeRam.com for the purpose of reserving the coin will not be eligible for a refund under any circumstances or conditions. Members should exercise caution and consider this non-refundable nature of the Customer Advance when deciding to proceed with their reservations on the KanKanMeRam.com platform.

SYSTEMS

The Platform's operations shall be conducted on an automated basis. Registered Members will be required to connect to the Platform over the Internet.

Operations on the Platform shall be allowed through suitable internet-connected devices of a Registered Member. Each Registered Member shall login their respective Kuberjee Gold (Payment Partner) account by entering their respective mobile number. A Registered Member shall have a non-exclusive permission to use the Platform in the ordinary course of business. A Registered Member shall not have any title, rights or interest with respect to the Platform, its facilities, software and the information provided by KanKanMeRam.com and the Platform.

A Registered Member shall not, by herself/himself or by through any other person(s), directly or indirectly:

• Use the Platform for any purpose other than that approved and specified by the Platform;
• Copy, alter or modify the Platform, or make the Platform available to any other person;
• Use the Platform in any manner other than the manner as specified by KanKanMeRam.com;
• Attempt - directly or indirectly - to decompile, dissemble or reverse engineer the Platform;
• Publish, supply, show or make available to any other person or reprocess, retransmit, store or use the facilities of the Platform.

CONTROL & REPORTING SYSTEMS

The Platform may, at the decision of KanKanMeRam.com, cease operations in Coins (Selected denominations of Gold and Silver as specified by the Platform) on the system for such an amount of time and for such reasons as it may deem fit in the best interests of the Registered Members and the overall markets. Orders, if any, in violation of an operation cease, will be rejected by the Platform.

Details of transactions conducted by Registered Members would be updated with the back-office systems of KanKanMeRam.com on a real time basis. Registered Members can access the reports of their transactions over the Platform. KanKanMeRam.com may record such additional information about the buying conducted on the Platform as it may consider relevant or necessary for its own use.

INTERMEDIARIES

KanKanMeRam.com may appoint Intermediaries and Distributors who shall assist us in distributing our products to you. KanKanMeRam.com shall communicate all the transaction details to you directly by means of emails, SMS and any other medium. and it is your responsibility to ensure that you receive this communication. When you visit the Platform or send emails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We may communicate with you by one or more letters, e-mail, SMS, phone calls or by posting notices on the Platform. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy all legal requirements that such communications be in writing. KanKanMeRam.com shall not be responsible to you in the event of default or any wrongful, dishonest, criminal, fraudulent act or willful misconduct or gross negligence on the part of these Intermediaries. However, you shall immediately inform KanKanMeRam.com on occurrence of such an event through e-mails/telephone/fax or any other convenient means. The activities of the Intermediaries and its personnel/ representative(s) shall not be construed to be activities of KanKanMeRam.com.

FORCE MAJEURE

In case of inability of KanKanMeRam.com to make deliveries of coins due to reasons beyond its control, KanKanMeRam.com may require that the deliveries be effectuated through specific modes, including through local merchants / jewelers. In such a case, you agree to bear any additional costs and fees necessary for the delivery to be complete.

FRAUDULENT TRANSACTIONS

The Customer should take care not to share their login credentials, mobile wallet details, personal UPI pin or OTP (“Payment Information”) with any third party intentionally or unintentionally. KanKanMeRam.com never solicits Payment Information over a call or otherwise. KanKanMeRam.com and/or the relevant Payment Gateway Partner(s) or KanKanMeRam.com Partners shall not be liable for any fraud due to the sharing of such details.

In the event that an individual’s Payment Information and/or payment instrument is fraudulently utilized to purchase Product(s) on the Platform (“Fraudulent Transaction”) from KanKanMeRam.com, then KanKanMeRam.com may share relevant information of such transaction if the victim approaches KanKanMeRam.com via proper channels including KanKanMeRam.com’s customer support number and email (contact@kankanmeram.com), along with supporting documentation from the relevant public authority or Cyber Cell.

In the event that KanKanMeRam.com and/or the KanKanMeRam.com Partner or Payment Gateway Partner(s) have flagged any transaction or Customer’s Account as suspicious as per their internal guidelines, or where it is found that a Customer has utilised Payment Information or a Payment Instrument in an unauthorised or fraudulent manner to purchase Product(s) or undertake any other transaction on the Platform (“Fraudulent User”), KanKanMeRam.com and/or the Payment Gateway Partner(s) shall be entitled to:

• request further KYC information or other documentation from the Fraudulent User to verify the flagged transaction;
• pending further verification, block such Fraudulent User, and/or freeze any accounts associated with them;
• reverse any such Fraudulent Transaction, to the extent possible, including the sale of any Product(s) purchased by such Fraudulent User, at the prevailing rate;
• provide information on such Fraudulent User, along with any other transaction details, to the relevant authorities.

In the event of a Fraudulent Transaction as aforesaid, KanKanMeRam.com shall make a reasonable effort to assist the victim in recovering their funds, subject to supporting evidence and documentation being provided upon request. KanKanMeRam.com shall be entitled to transfer the victim’s funds, less any payment gateway charges that are not refunded to the relevant Payment Gateway Partner(s). 

However, it is clarified that KanKanMeRam.com shall not obligated to reverse any transaction where the Fraudulent User has already sold the Product(s) purchased through the Fraudulent Transaction and received the funds against such sale; or where the Fraudulent User has chosen to take delivery of the Product(s) so purchased. In this event, KanKanMeRam.com shall, to the best of its ability, provide any information on the Fraudulent User, including the bank account or mobile wallet account to which funds have been settled, or the physical address to which the Product(s) has been delivered, to the victim or the relevant authorities.

SUSPENSION / CLOSURE OF CUSTOMER’S ACCOUNT

KanKanMeRam.com may, at its discretion, suspend any Customer’s Account, if there appears to be a fraudulent or suspicious activity in the Customer’s Account. If KanKanMeRam.com is of the opinion that any Customer is involved in any unlawful activity or the Customer’s Account is used for any unlawful purpose, KanKanMeRam.com shall have the right to take all actions available to it, including black-listing or blocking such Customer from using its Platform for making purchases or blocking the said Customer’s access to the purchase-related services through the Platform or intimating the relevant authorities of such unlawful activities. 

KanKanMeRam.com shall not be held liable/responsible, in any manner whatsoever, for any loss/liability arising out of or relating to any technical failure/issue in Platform and/or acts/omission not attributable to it.

The Customer shall inform immediately, in any case no later than 10 (Ten) Business Days of the transaction, of any irregularities or discrepancies that may exist in the Customer Account, failing which it shall be deemed that there is no error or discrepancy in the said Account. All records maintained by KanKanMeRam.com, in electronic or documentary form of the instructions of the Customer and such other details (including, but not limited to payments made or received) pursuant to the Terms and Conditions, shall as against the Customer, be deemed to be conclusive evidence of such instructions.

GOLD AND SILVER COIN

Through the Platform, KanKanMeRam.com shall facilitate buy of Gold and Silver Coin. All such buy transactions are final and non-reversible.

KanKanMeRam.com will provide purchase quotations for gold and silver coins at fixed prices that remain constant on the platform. You can acquire any quantity of these coins through the KanKanMeRam.com platform, adhering to the platform's established policies. Upon your purchase, KanKanMeRam.com will provide you with a receipt confirming the coins you have reserved.

PLACEMENT OF ORDERS

The prices of coin shown on the Platform would be an invitation to offer to all eligible Account holders. An order legitimately placed by an eligible Account holder would constitute an offer for purchase of the Gold or Silver coin, as the case may be. KanKanMeRam.com may accept or reject such an offer, at its discretion.

You possess the right to secure gold or silver coins via our pre-booking option. Our purchase schemes include both spot purchases, where payment is made immediately, and instalment-based purchases facilitated through EMIs. You also accept that you will receive the price at which your order executes in our systems, which may be different from the price at which Gold or Silver is trading at when you enter your order into our system. We want to make you aware that once you place an order, it cannot be altered or modified. Furthermore, please note that the price of your order will not be adjusted based on market fluctuations it will remain unchanged.

BUYING / REDEMPTION FUNCTIONS

The purchase prices and the spread between them will remain constant and will not be subject to changes due to several factors, such as price volatility, supply considerations, external market conditions, and other relevant factors. An order which does not conform to the specifications laid down by KanKanMeRam.com and the Platform shall be considered as void. In case you face any technical, network or unexplained issues during the processing of your transaction, your amount will be refunded back to your account. You are requested to reinitiate the transaction during such scenarios. KanKanMeRam.com will not be responsible for any difference in the rates of any product.

Following functions can be performed by the Registered member:

• A Registered member can buy gold and silver coin in any quantity in grams. There is no upper limit on purchase quantity. 
• The customer shall pay the amount using a payment gateway immediately at the time of buying the gold/silver coin.
• Upon successful execution of buying, KanKanMeRam.com will provide you with a receipt confirming the coins you have reserved.

PRODUCT

The company acknowledges that some items may appear larger or smaller due to screen defaults and photography techniques and shall not be liable for any legal action on this account. All the details regarding the product shall be clearly displayed on the Platform.

Due to system errors, data may occasionally be displayed incorrectly on the Platform. KanKanMeRam.com reserves the right to correct any and all errors when they do occur and KanKanMeRam.com shall not honour inaccurate or erroneous prices. However, it is important to note that the delivery charges for the listed products are free and are not open to negotiation.

TERMS AND CONDITIONS FOR EMI

The Scheme is unique and shall not be linked to any other existing or future Schemes/Offers and is not transferable under any circumstances.

During the scheme's tenure, the product purchased and the specifications mentioned upon pre-book Order Confirmation cannot be changed, and the Customer shall make payments according to the payment schedule provided during pre-book Order confirmation. The money paid as booking amount under the Scheme shall not bear any interest.

It is important to note that the company will persist in generating Proforma Invoices until all EMIs have been fully paid, and these will be promptly sent to the customer. After the Dussehra, the product shall be delivered at the delivery location provided by Customer within fifteen (15) working days of receiving the full payment from the Customer, but delivery times may vary due to product specifics and unforeseen circumstances.

The Customer may be provided a grace period of five (5) days every month beyond his/her respective payment due date. In case the customer fails to make payment beyond such grace period, then KanKanMeRam.com at its sole discretion may cancel the order as per the terms explained below.

Once a Customer's Purchase Order has been confirmed after pre-booking, it cannot be cancelled. However, in the event that KanKanMeRam.com cancels a Customer's Purchase Order as per the terms outlined above, the following charges will apply and be deducted from the amount paid by the Customer for the Product:

• The cancellation price for each product shall be updated by KanKanMeRam.com on a daily basis for facilitating cancellation.
• If the cancellation price as on the date and time of cancellation is higher/lower than the Order Value, then the difference between the order value and the cancellation price as on the date of cancellation plus cancellation charges as determined by KanKanMeRam.com from time to time shall be deducted from the payments made by the customer and balance shall be refunded to the customer’s bank account only.

In the event of changes in applicable laws, statutes, rules and regulations including changes in taxes, hallmarking charges, etc. KanKanMeRam.com shall be entitled to collect from the customer at the time of delivery/closure or otherwise as indicated by KanKanMeRam.com before the receipt of last instalment, an increase in taxes, or charges or costs which may be levied or any new taxes or charges or costs which may be imposed by the competent authorities from time to time.

In the unfortunate event of death of the customer, the product shall be handed over to the legal heir of the Customer after due verification.

Order fulfilment by KanKanMeRam.com is subject to the realization of the total Purchase Price from the Customer.

The Customer is advised that proper KYC is updated at the time of purchasing the Product to enable KanKanMeRam.com to identify the Bona fide Customer. In any case the Customer will be prompted to provide their PAN details once the Customer’s Purchase Order reaches a certain threshold limit.

KanKanMeRam.com reserves the right to stop facilitating the Scheme on Platform at its sole discretion. All Orders previously placed shall stand active and shall be fulfilled by KanKanMeRam.com.

KanKanMeRam.com does not charge any processing fee for the purpose of facilitating the Scheme for its Customers.

KanKanMeRam.com will communicate with the Customer by email or other electronic methods which will be deemed as adequate means for service of notice or communication.

All transactions on the Platform and use of services of KanKanMeRam.com shall be subject to true, fair and accurate disclosure of information by the Customer as may be called for.

The recipient of the Products is obliged to produce identity proof and/or address proof or such other documents to verify and establish as being bona fide Purchaser/ Recipient at the time of delivery to ensure safe delivery of the Products purchased.

DELIVERY

Delivery shall be made by the Company / courier agent at your doorstep. All items shall be delivered directly to such person and under any circumstances whatsoever, the Member cannot change the recipient details after the order is processed. Members do not have a direct option to modify their shipping address before the product is shipped. However, if they need to change the delivery address, they can do so by contacting the company via email to request the change. It is important to note that the shipping address cannot be changed once the order is processed. The recipient of the products is obliged to produce identity proof and/or address proof or such other documents to verify and establish as being bonafide recipient at the time of delivery to ensure safe delivery of the products. 

The product shall be delivered at the delivery location provided by Customer within fifteen (15) working days of receiving the full payment from the Customer. Nevertheless, it is important to acknowledge that the delivery timeframe may vary based on the specific product and any unforeseen circumstances that may impact the delivery process. This variability in delivery schedules can stem from several factors, such as the need for additional time for product customization, specialized handling requirements, or other unforeseen variables that may arise during the delivery process. We are committed to making every effort to ensure timely delivery and will keep the Customer informed in case of any delays or modifications to the expected delivery schedule.

Recipient accepting delivery should carefully examine the package delivered and shall not accept deliveries where the packaging has been tampered with. The recipient receiving the delivery also has the option to open the package and check its contents prior to accepting the delivery or signing the delivery receipt. They shall not accept deliveries, where they find that the box is empty or the contents are damaged or the contents are not in accordance with the order placed.

The recipient, upon signing the delivery receipt, acknowledges the receipt of the product in terms of the order placed with the Company. The Company is not liable to the Customer / recipient for any refund / replacement, under any circumstance, for any subsequent complaints with respect to such deliveries.

If the recipient is not available at the time of delivery, the Company / courier agent shall try and deliver the item thrice before returning the same to KanKanMeRam.com. All costs for re-shipment and handling in the case of non-delivery to the Customer shall be chargeable to the Customer.

RETURN & REPLACEMENT POLICY

If and only if you receive a damaged / defective article or an article that does not comply with the specifications as per your original order, you are required to get in touch with the customer service team within three (3) business days from the date of receipt of such delivery. 

Upon receiving your complaint, KanKanMeRam.com will initiate a verification process to confirm the authenticity and nature of the complaint. If KanKanMeRam.com determines that the complaint is genuine, KanKanMeRam.com shall provide a free replacement subject to the Product being sealed and is returned in the same tamper proof blister packaging in an intact, un-opened and non-mutilated condition in which it was delivered to the Customer. However, it's essential to clarify that if the complaint pertains solely to the customer's dissatisfaction or personal dislike of the product, the company will not provide a replacement and in the event of frivolous and unjustified complaints regarding the quality and content of the products, KanKanMeRam.com reserves the right to pursue necessary legal actions against you and you will be solely liable for all costs incurred by KanKanMeRam.com in this regard.

Before accepting shipment of any product, kindly ensure that the product’s packaging is not damaged or tampered. If you observe that the package is damaged or tampered, request you to refuse to accept delivery and inform KanKanMeRam.com at the earliest. The return process of the product may be restricted by KanKanMeRam.com depending on the nature and category of the product.

It shall be the responsibility of the User to ensure safe delivery of the defective/damaged product to KanKanMeRam.com’s custody. Till such time that the receipt is acknowledged as received by KanKanMeRam.com the risk of loss of the said product shall remain with the concerned Registered member.

REFUNDS

The KanKanMeRam.com upholds a stringent no-refund policy, which implies that it does not provide refunds for any of its products.
